TERMS OF SERVICE — DUSK CAMPERS

1. About Us

This website is operated by Sino7 Enterprises Pty Ltd (ABN [your ABN]) trading as DUSK Campers, a licensed motor vehicle dealer in Queensland, Australia. Throughout these Terms, "we," "us," and "our" refer to DUSK Campers.

By accessing this website or engaging with us to purchase a vehicle or related products, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website or our services.

2. Products and Services

DUSK Campers sells brand new Toyota HiAce H300 campervans that have undergone second-stage manufacturing (SSM) to produce ADR-compliant, VSB14-compliant, compliance-plated vehicles. We also sell optional extras, accessories, and related products.

All vehicles are sold as new motor vehicles through our licensed dealership. Each vehicle is individually built and may vary in specification depending on the options selected by the buyer.

3. Pricing and Quotations

All prices displayed on this website are in Australian Dollars (AUD) and include GST unless otherwise stated.

Vehicle prices displayed are for the base vehicle with standard inclusions and exclude government and statutory charges, including but not limited to registration, stamp duty, compulsory third party (CTP) insurance, transfer fees, and any applicable luxury car tax. These on-road costs vary by state and territory and will be itemised in your individual quotation.

Optional extras are priced separately and will be added to your total purchase price as selected.

Prices are subject to change without notice. A quoted price is only binding once confirmed in a written sales agreement signed by both parties. We reserve the right to correct any pricing errors on the website.

4. Orders and Deposits

A purchase is not confirmed until we have issued a written sales agreement and received the agreed deposit. Deposits, payment schedules, and cancellation terms are specified in your individual sales agreement.

We reserve the right to decline any order at our discretion.

Build-to-order vehicles are subject to production timelines that may vary depending on Toyota Australia supply, component availability, and build scheduling. Estimated delivery timeframes are provided in good faith but are not guaranteed.

5. Payment

We accept payment by bank transfer, credit card, and other methods as specified at the time of sale. Full payment, including all on-road costs, is required prior to vehicle registration and delivery.

Payment terms for deposits and progress payments will be outlined in your individual sales agreement.

6. Vehicle Specifications and Descriptions

We make every reasonable effort to ensure that vehicle descriptions, photographs, specifications, and features displayed on this website are accurate. However, actual vehicles may differ slightly from images shown due to manufacturing tolerances, screen display variations, updates to specifications by Toyota Australia, or component substitutions required during the build process.

Any material changes to your vehicle's specification from what was agreed in your sales agreement will be communicated to you prior to delivery.

7. Delivery and Acceptance

Vehicles are available for collection from our Southport, Queensland showroom unless alternative delivery arrangements are agreed in writing.

Upon delivery, you will be invited to conduct a thorough inspection of the vehicle. By accepting delivery and signing the delivery acknowledgment, you confirm that the vehicle is in satisfactory condition and matches the agreed specification, subject to your ongoing rights under Australian Consumer Law.

8. Registration and Compliance

Each DUSK Camper is supplied with a compliance plate as a second-stage manufactured vehicle meeting Australian Design Rules (ADR) and Vehicle Standards Bulletin 14 (VSB14) requirements. We will assist with the registration process in Queensland. Interstate registration is the responsibility of the buyer, though our vehicles are eligible for registration in all Australian states and territories.

Once a vehicle has been registered in your name, title passes to you and the sale is final, subject to your rights under Australian Consumer Law.

9. Warranty

Each vehicle is supplied with the applicable Toyota Australia manufacturer warranty covering the base vehicle. The second-stage manufacturing conversion is covered by a separate warranty, the terms of which will be provided at the time of purchase.

All warranties operate in addition to, and do not limit, your rights under the Australian Consumer Law.

10. Returns and Refunds

Please refer to our Return and Refund Policy, which forms part of these Terms. In summary, we do not accept returns for change of mind. Your rights under the Australian Consumer Law consumer guarantees are fully preserved.

11. Website Use

You may use this website for lawful purposes only. You must not use this website in any way that breaches any applicable law or regulation, is fraudulent, or is harmful to any third party.

All content on this website, including text, images, logos, graphics, and design, is the property of Sino7 Enterprises Pty Ltd or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

12. Privacy

We collect and handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Information collected through this website, including via enquiry forms and email sign-ups, is used for the purpose of responding to your enquiry, processing sales, and providing you with relevant communications.

We will not sell or disclose your personal information to third parties except as required to process your purchase (for example, to Toyota Australia for warranty registration, or to relevant government authorities for vehicle registration), or as required by law.

You may request access to, correction of, or deletion of your personal information by contacting us directly.

13. Limitation of Liability

To the maximum extent permitted by law, DUSK Campers excludes all liability for any indirect, incidental, special, or consequential loss or damage arising from or in connection with the use of this website or the purchase of any vehicle or product.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other legislation that cannot be lawfully excluded.

14. Indemnification

You agree to indemnify and hold harmless Sino7 Enterprises Pty Ltd, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms or misuse of this website.

15. Third-Party Links

This website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any linked websites. Inclusion of a link does not imply endorsement.

16. Amendments

We reserve the right to update these Terms at any time. Changes take effect when published on this website. Your continued use of the website following any changes constitutes acceptance of the revised Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms or from a vehicle purchase will be subject to the jurisdiction of the courts of Queensland. For motor vehicle disputes, you may also have the right to lodge a claim with the Queensland Civil and Administrative Tribunal (QCAT) in accordance with the Motor Dealers and Chattel Auctioneers Act 2014 (Qld) and the Fair Trading Act 1989 (Qld).
